■ Sumida Aquarium Terms of Use

Article 1 Applicability
These terms of use (‘the Terms of Use’) apply to all visitors entering the Sumida Aquarium (‘the Aquarium’) operated by the ORIX Real Estate Corporation (‘the Company’). Matters not specified in the Terms of Use will conform to applicable laws, regulations and generally accepted practices.

Article 2 Tickets
1. A ticket is required for admission.
2. Ticket purchases are subject to the Sumida Aquarium Electronic Ticketing Terms of Use and the Sumida Aquarium Ticket Sales Terms and Conditions specified separately by the Company.
3. Expired tickets, discount coupons or other instruments cannot be used.

Article 3 Prohibited Acts
The acts listed below are prohibited within the Aquarium. Violations of this article will be assessed by the Company or the Aquarium employees (‘the Staff’).
<General>
(1) Making unauthorized use of a ticket or annual pass
(2) Using a firearm or explosive
(3) Smoking (including use of an electronic smoking device)
(4) Excessive intoxication
(5) Moving a fixture or merchandise without authorization of the Company
(6) Damaging a fixture or merchandise
(7) Engaging in an act that constitutes or might constitute a disturbance to other visitors or the Staff, violence, a threat, menacing, extortion, coercion, intimidation, or a demand for money or goods
(8) Entering a restricted area
(9) Restraining the Staff: Talking excessively, making continuous or persistent inquiries, refusing to leave, lingering or making repetitive demands or inquiries, or other acts that impede duties of the Staff
(10) Subjecting the Company or the Staff to any inappropriate demands for service outside socially accepted norms, a demand for a groveling apology, or a demand for disciplinary action against the Staff
(11) Attempting to secure or occupy a seat or exhibition area by the deposit of personal belongings
(12) Climbing or hanging from any structure in the Aquarium property, such as a decorative structure, fence, fixture or the like
(13) Running around the Aquarium
(14) Neglecting the protection or supervision of an accompanying visitor
(15) Entering the Aquarium on a skateboard, inline skates, roller skates, scooter, bicycle or other vehicle deemed inappropriate by the Company
(16) Engaging in an activity of a political organization or organized criminal enterprise, a religious activity or the like
(17) Using a power outlet without authorization of the Company
(18) Engaging in vocal training or a performance, or using audio equipment
(19) Talking loudly on a smartphone or other mobile device
(20) Using a wireless device or loudspeaker, or handing out fliers or other materials
(21) Engaging in a product sale or promotion not authorized by the Company
(22) Providing a handout or gift to the Staff
(23) Posting false information on a social media site or other website
(24) Refusing to follow instructions of the Company or the Staff
(25) Engaging in an act that violates or might violate a law
(26) Bringing any of the following items into the Aquarium:
   ・A dog, cat, small bird, insect, other pet, livestock or other animal (guide dogs and other support dogs are permitted)
   ・A legally prohibited gun, sword, narcotic, other drug or harmful substance
   ・A flammable substance (lighters or matches used as smoking aids are permitted)
   ・A large personal belonging, handcart or child carrier other than a stroller (such as a garden cart or wagon)
   ・An item that generates significant noise or odor (including excessive perfume or other body scents)
   ・An item that might affect any creatures in the Aquarium (such as a balloon, laser pointer or soap bubble blower)
   ・A weapon
   ・Other items that might disturb other visitors
(27) Engaging in any act that constitutes or is similar to customer harassment, defined in ordinances, manuals, guidelines or other standards by the government or industry groups
(28) Engaging in any other act deemed inappropriate by the Company or the Staff
<Aquarium Creatures, Exhibits>
(1) Feeding any Aquarium creature without authorization of the Company
(2) Hitting, damaging, breaking or vandalizing any Aquarium creature or exhibit tank
(3) Reaching for or touching any Aquarium creature without prior approval of the Company or the Staff
(4) Hand signaling, gesturing, whistling or waving flags toward any Aquarium creature
(5) Placing hand or any object into or on top of the water surface of any exhibit tank or pool
(6) Directing a question or comment about an Aquarium creature to the Company or the Staff that is deemed inappropriate by the Company
<Taking Photographs, Recording Video, Streaming>
(1) Livestreaming or live broadcasting without authorization of the Company
(2) Taking photographs or recording audio or video for a commercial purpose without authorization of the Company
(3) Taking photographs or recording video with an accessory such as a monopod, tripod or selfie stick, or using a drone or radio-controlled device
(4) Taking photographs, recording video or using an electronic flash device in an area where such actions are prohibited

Article 4 Admission Restrictions
Visitors may be refused entry to the Aquarium or be asked to leave by the Company or the Staff in the cases below. Violations of this article will be assessed by the Company or the Staff based on rational grounds. The cost of previously purchased tickets will not be refunded when the Company or the Staff act under the provisions of this article.
(1) When the visitor has engaged in a prohibited act described in Article 3 or an act violating the Terms of Use
(2) When the visitor has subjected the Aquarium or the Staff to violence, threat, menacing, extortion, coercion, intimidation, demand for money or goods, threatening behavior or the like, or made a demand for an imposition exceeding commercially reasonable limits; when the visitor is found to have previously engaged in the same behavior at another facility
(3) When the Aquarium deems the visitor has contracted or might have contracted a contagious disease
(4) When the visitors constitute an organized crime group, designated organized crime group, designated organized criminal alliance, or other group likely to encourage collective or habitual illegal acts as defined in Japanese law (Article 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members; Act No. 77 of 1991), when the visitor is a member thereof, or when the visitor has dealings or a relationship with a member thereof
(5) When the visitors constitute an organization sentenced under Japanese law (Act on the Control of Organizations Which Committed Indiscriminate Mass Murder; Act No. 147 of 1999), when the visitor is a member thereof, or when the visitor has dealings or a relationship with a member thereof
(6) When the visitors constitute an organization similar to the organizations of Items (4) or (5), when the visitor is a member thereof, or when the visitor has dealings or a relationship with a member thereof
(7) When criminal proceeds as defined by Japanese law (Act on Punishment of Organized Crimes and Control of Proceeds of Crime; Act No. 136 of 1999) have been or are suspected of having been concealed or received by the visitor or by a party with which the visitor has dealings
(8) When the visitor has committed wrongdoing that constitutes a crime involving criminal proceeds as defined by Japanese law (Act on Prevention of Transfer of Criminal Proceeds; Act No. 32 of 2007, amended Act No. 37 of 2019)
(9) When the visitors constitute a corporation having a party constituting any of the parties of Items (4) to (8) as an officer, employee, parent company or affiliate
(10) When the Aquarium deems the visitor will not or might not comply with the Terms of Use
(11) For any other act for which the Company decides to restrict admission

Article 5 Disclaimers
The Company will bear no liability for damage compensation in the following cases:
(1) An incident caused by an earthquake, fire, typhoon or other natural disaster
(2) An incident caused by inadequate visitor care
(3) Theft or loss of an article, personal belonging, child stroller or other possession of a visitor
(4) A dispute, disturbance or incident arising between visitors
(5) An incident caused by failure to comply with a warning, demand or guidance from the Company or the Staff (delivered verbally or via facility signage)
(6) A disturbance caused by the release of audio, video or a still image recorded by a visitor
(7) A change or cancellation of operating hours, event content or schedule resulting from weather conditions, facility inspection, the condition of an aquarium creature, or other circumstances

Article 6 Operations
The Company reserves the right to change hours of operation, close the Aquarium, change or discontinue an exhibition, or modify event content without prior notice in the cases below.
(1) In cases of the need for equipment inspection, repair or work arising
(2) When the condition of a creature demands special care, or to ensure the safety thereof
(3) In the event of an earthquake, fire, typhoon, deteriorating weather conditions, natural disaster or incident
(4) Upon demand by a government agency, court, industry group or other authority
(5) In the event of an outbreak of a contagious disease
(6) In any other case deemed necessary by the Aquarium

Article 7 Damage Compensation, Legal Action
The Company will demand damage compensation from a visitor in the cases below (including but not limited to the actual cost of repair, cleaning and restocking, and reparation for pain and suffering or a defamatory act). The Company may respond with rigorous measures such as suing for damage compensation or taking other legal action.
(1) If the Company, the Aquarium, an aquarium creature, an aquarium fixture or the like is damaged, broken, defaced or lost
(2) In case the Staff, another visitor or other third party is victimized by the act
(3) In the event of another violation of the Terms of Use
(4) If costs or damages are incurred by the Company

Article 8 Personal Information Handling
Personal information obtained by the Company will be used for ticket sales, issuing and managing annual passes, mailing lists, corporate promotions and the usage objectives specified by the Company’s Privacy Policy (Privacy Policy: Identity theft prevention measures | ORIX Real Estate Corporation).

Article 9 Changes
If deemed necessary thereby, the Company reserves the right to make a change to the Terms of Use at any time by notifying the nature of the change, and effective date thereof (the ‘Effective Date, etc.’) at least two weeks in advance thereof. If a change will be made to the Terms of Use, the Effective Date, etc. will be posted on the Aquarium’s official website (https://www.sumida-aquarium.com).

Supplementary Provisions
Article 1 Date of Effect
The Terms of Use will take effect on October 1, 2024.
